Gift Cards Terms And Conditions

The following Watershed Ent. Hot Tub Inn Gift Cards Terms and Conditions (these “Terms”) Digital Watershed Ent. Hot Tub Inn gift cards are governed by the Terms of Use for Hot Tub Inn's online services. These Terms are between you, the purchaser, and Hot Tub Inn. By purchasing, accepting or using a Hot Tub Inn gift card, you agree to be bound by these Terms. If you do not agree with the Terms, do not purchase, use or accept a Hot Tub Inn gift card.

1. Gift Cards. Gift cards are redeemable for Hot Tub Inn only and can be used online or in person with a hot tubby worker for any question that may arise in regards to this please call us anytime at (385)501-5060. After using your gift card, the balance will immediately be deducted from the order total. If your purchase exceeds the amount of the gift card, you will need to pay the balance. When redeeming online or by telephone or in person, this balance must be paid by credit card.

1.1. Expiration. Hot Tub Inn gift card balances do NOT expire.

1.2. Viewing Your Balance. You may check the available balance on your gift card with any Hot Tubby worker or using the Online Services. Any remaining balance on your gift card can be used for future purchases. Balances cannot be redeemed or exchanged for cash, except where required by applicable law.

1.3. Returns. Gift cards cannot be returned or cancelled after purchase.

1.4. Lost or Stolen Gift Cards. Gift cards cannot be replaced if lost or stolen without proper proof of purchase.

1.5. Fraud. Hot Tub Inn reserves the right to refuse, cancel, or hold gift cards and orders for suspected fraud, for cards mistakenly issued in an incorrect denomination or for other violations of these Terms.

1.6. Reloading Value. You can reload your gift card with Hot Tub Inn - Call, E-mail, or in person and through the Online Services using the “Reload” option.

Miscellaneous. Miscellaneous. Gift cards may be purchased using the Online Services. No taxes are charged on the purchase of gift cards. Applicable taxes are charged when gift cards are redeemed. Gift cards may not be resold. Gift cards purchased though any unauthorized resellers, e-bay or other internet auction sites are not guaranteed by Hot Tub Inn. Information that you provide when purchasing a gift card is subject to Hot Tub Inn's Privacy Policy.

No Warranties; Limitation on Liability. YOU AGREE THAT THE GIFT CARDS ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND HOT TUB INN SPECIFICALLY AND EXPRESSLY DISCLAIMS ANY AND ALL REPRESENTATIONS OR WARRANTIES, IMPLIED OR EXPRESS, INCLUDING, WITHOUT LIMITATION, ANY REPRESENTATIONS OR WARRANTIES OF SUCH TITLE, WARRANTIES OF THE MERCHANTABILITY OR FITNESS FOR THE PARTICULAR PURPOSE AND ANY AND ALL WARRANTIES THAT MAY ARISE FROM ANY COURSE OF DEALING, COURSE OF ANY PERFORMANCE OR USAGE OF TRADE. IN THE EVENT THAT A HOT TUB INN GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD.

Governing Law and Venue. These Terms of Use shall be governed by and it shall be total construed in accordance with the laws of the Utah State, without any regard to its conflicts of the law principles. Any action or proceeding between you and Hot Tub Inn relating to or any arising out of these Terms of Use or your use of the Online Services for gift card(s) shall be maintained and commenced directly in the state or federal courts in Utah, and you directly consent to the exclusive jurisdiction and venue of any state or federal court in the Utah state.
